If you sell into regulated industries, Anthropic's watermarking is now a checkbox your competitors will use in RFPs, plan your answer.

Anthropic rolled out invisible watermarking for all Claude output worldwide this week. Every model released after August 2 now weaves a machine-readable signature into the text it generates. The watermark survives copy and paste but degrades if someone rewrites the content heavily. Images get a different treatment: C2PA-signed metadata that proves provenance. Anthropic says this is about complying with Article 50 of the EU AI Act, but they’re applying it globally rather than just inside Europe.

The company is clear on one point. If you build a product on top of Claude, your own Article 50 compliance is still your problem. The watermark helps, but it doesn’t absolve you of the legal duty to assess and disclose how AI fits into your workflow. That matters because regulators are starting to ask hard questions about who is responsible when AI-generated content goes into customer-facing systems.

The story hit number one on Hacker News, and the comment thread is predictably split. Some developers see this as a reasonable transparency measure. Others worry it sets a precedent for tracking and controlling model output in ways that could limit how freely businesses can use these tools. The watermark is imperceptible to humans, so it won’t disrupt user experience, but it does mean every piece of Claude-generated text is now tagged at the source.

For operators, the takeaway is straightforward. If you use Claude in production, you need to document it. If you’re in a regulated industry or selling into the EU, you need a plan for how you’ll demonstrate compliance.
